Terms<\/span> &<\/strong> Conditions of SmartWills Online Will Writing Service<\/span><\/strong><\/p>\n

The Online Will Writing Service (\u201cService\u201d) is provided by <\/span>My Smartwills Limited [3246913] (\u201cMSL\u201d)<\/b>. These are the terms and conditions governing the access, provision and use of the Service<\/span> (\u201cTerms and Conditions\u201d, or \u201cT&C\u201d).<\/b><\/p>\n

You shall indicate your understanding of the Product Disclosure Sheet of the Service (\u201cProduct Disclosure Sheet\u201d, or \u201cPDS\u201d) and agreement to the Terms and Conditions and accept responsibility for your use of the Service by clicking on the \u201cAccept\u201d button appearing at the end of the Terms and Conditions. You should read the Product Disclosure Sheet and the Terms and Conditions carefully before you click the \u201cAccept\u201d button and accept them. If you click the \u201cCancel\u201d button, there will be no subscription for the Service.\u00a0<\/span><\/p>\n

Please note that the use of this service must comply with all relevant laws, regulations, and the aforementioned terms and conditions of Hong Kong<\/strong>. Unauthorized access and use are strictly prohibited.<\/span><\/p>\n

1. Definitions<\/b><\/p>\n

For the purpose of the Terms and Conditions, the following terms shall, unless the context otherwise requires, have the meanings as defined below. All other terms not defined herein shall have the meaning as may generally be accepted within the industry based on the context used herein.<\/span><\/p>\n

\u201cWill\u201d<\/strong> \u2013 <\/span>Means the Will for a Non-Muslim person made available by<\/span> MSL<\/b> following subscription to the Service.<\/span><\/p>\n

\u201cWebsite\u201d<\/strong> \u2013 Means www.smartwills.com.hk<\/span>
<\/b><\/p>\n

\u201cFee and Charges\u201d<\/strong> \u2013 <\/span>Refers to the current fees payable for each subscription package of this service, as updated and indicated on the website. The specified fees do not include any government taxes, as Hong Kong currently does not implement Goods and Services Tax (GST) or similar Value-Added Tax (VAT). If any new taxes are imposed by the government in the future and are applicable to our services, they will be charged separately.<\/span><\/p>\n

2.General Terms<\/b><\/p>\n

2.1 You must first have a valid username and password and subscribe for the Service.<\/span><\/p>\n

2.2 The Service is for your exclusive use only. You are prohibited from using the Service on behalf of another person EXCEPT our authorized resellers (herewith known as \u201cSmartWriters\u201d) who are permitted to use the Service on behalf of their clients.<\/span><\/p>\n

2.3 You acknowledge and agree to accept the Service via the secured Website in accordance with the Terms and Conditions.<\/span><\/p>\n

2.4 <\/span>MSL<\/b> reserves the right to reject your subscription for the Service at its sole and absolute discretion without providing any reasons whatsoever.<\/span><\/p>\n

2.5 <\/span>MSL<\/b> will make available the electronic copy of the Will (in PDF format) as an email attachment to your email address as provided by you within 24 hours, or delivery of printed copy as per our add-on premium service to your postal address within five (5) working days, from you having provided complete and accurate information and received the payment confirmation notification of the Fees to our payment gateway.<\/span><\/p>\n

2.6 You may at any time cancel or unsubscribe for the Service provided that such cancellation or unsubscription is done prior to the payment of the Fees.<\/span><\/p>\n

2.7 <\/span>MSL<\/b> reserves the copyright of the Will and you undertake to not copy or re-use the content of the Will and\/or share or distribute the content of the Will to any other party or for any commercial use.<\/span><\/p>\n

2.8 You are advised to contact <\/span>MSL<\/b> should you require additional information or clarification in respect of the Service or should you have any special instructions for the writing of a Will.<\/span><\/p>\n

2.9 <\/span>MSL reserves the right at its sole and absolute discretion to vary, supplement, delete, amend or modify any of the Terms and Conditions from time to time by giving a minimum of fourteen (14) days prior written notice thereof. The notice setting out the variation, supplemental, deletion, amendments or modification, as the case may be to the Terms and Conditions and the duly varied, amended, supplemented and modified Terms and c<\/span><\/b>onditions shall be posted on the Website.<\/span><\/p>\n

2.10 By clicking the on the \u201cAccept\u201d button appearing at the end of the Terms and Conditions, you fully understand your right to consult a legal practitioner for advice in regards to the Will before signing the Will and <\/span>MSL<\/b> shall not be held responsible for your failure to do so and shall not be held liable for any loss and damage suffered by you for your failure to do so.<\/span><\/p>\n

2.11 By clicking on the payment button, you fully understand your responsibility and risk of accepting the service.<\/span><\/p>\n
